CONDOLÉANCES
A la famille
de Houssein Saïd Bogoreh
C´est par
l´intermédiaire de l'hebdomadaire électronique la
LIBERTÉ que j´ai appris la mort de mon ami Houssein Said
Bogoreh.
Je ne sais comment
exprimer ma peine, qui pour forte qu´elle soit, n´est que
l´ombre de la vôtre.
Perdre un fils
de 37 ans alors que ses qualités lui ouvraient le plus bel avenir
serait impossible á supporter si vous n´étiez entourés
par les autres fils de Said Bogoreh dons la présence sera votre
consolation.
Houssein Said
Bogareh était un ami personnel. La dernière fois que je
l´ai vu, c'était lors de mon passage au Canada en mars
1998.
Nous sommes entrés
le même jour dans l´armée Nationale Djiboutienne
le 08 février 1981 á Holl Holl..
Pour tous ceux
qui le connaissaient, Houssein Said Bogoreh était l´arbre,
le cailloux et le sable qui constituent la terre Djibouti, en d´autres
termes, il était un authentique enfant du pays.
Que dieu lui
ouvre son paradis "Amin"

Dans
ses recommandations, le Secrétaire général
de l'ONU, Kofi Annan, a
déclaré qu'une mission de la paix de l'ONU en
Éthiopie et en Erythrée
nécessiterait une force militaire totale de 4 200 personnes,
dont 220
observateurs militaires, trois bataillons d'infanterie et des
unités de
soutien. A l'occasion d'une réunion d'information jeudi
à New York, son
porte-parole adjoint, Manoel de Almeid E Silva a indiqué
que les
recommandations du Secrétaire général étaient
contenues dans un rapport
soumis au Conseil de sécurité. Dans le cadre de
l'accord de paix d'Alger,
l'Ethiopie et l'Erythrée avaient proposé que l'opération
de maintien de la
paix de l'ONU s'achève par un accord sur la démarcation
de la frontière
contestée. Dans son allocution, le porte-parole a déclaré
que la mission de
l'ONU surveillerait le redéploiement des forces éthiopiennes
sur les
positions qu'elles occupaient le 6 mai 1998, et contrôlerait
également la
position des forces érythréennes, qui doivent
se tenir à une distance de 25
km des forces éthiopiennes redéployées.
Cette mission surveillera aussi la
zone de sécurité temporaire, coordonnera et fournira
une assistance
technique pour le déminage.
SOMALIE
: Djibouti insiste sur une première session parlementaire
Des
sources de Djibouti ont indiqué à IRIN que le
président djiboutien
Ismail Omar Guelleh n'est pas satisfait du rythme de la Conférence
de
Djibouti pour la paix nationale en Somalie, financée
par le gouvernement de
Djibouti. Selon des sources de cette conférence, le président
Ismail Omar
Guelleh a menacé de faire enlever le chapiteau de la
Conférence si
l'Assemblée nationale transitoire (ANT) ne se réunissait
pas le dimanche 13
août. D'après ces mêmes sources, le président
de la conférence, Hassan
Abshire, a présenté au président les progrès
réalisés au cours de ce sommet
et a requis la patience. Mais M. Abshire a reconnu que la conférence
avait
été ralentie par la controverse sur l'attribution
des sièges à l'ANT,
soulevée par certains sous-clans qui menaçaient
de quitter la conférence.
Sous le poids d'une pression financière et politique,
M. Guelleh s'efforce
de faire aboutir les pourparlers somalis - la 13e tentative
de
réconciliation - et parvenir à un accord sur l'élection
d'un parlement, d'un
premier ministre et d'un président.
SOMALIE
: Manifestations contre la répartition des sièges
Des
centaines de personnes sont descendues mardi dans les rues de
la
capitale somalie, à Mogadiscio, pour protester contre
la répartition des
sièges à la future Assemblée nationale,
a rapporté l'AFP. Les manifestations
se sont déroulées dans le district de Hariryale
à Mogadiscio et dans deux
quartiers sud de la capitale, Gubta et Deymile. Les manifestants
étaient
essentiellement des membres du sous-clan de Murursade appartenant
au clan de
Hawiye.

BRUITS
ET RUMEURS
Un
communiqué rédigé par M Ali Dahan et diffusé
largement fait parler de lui au sein de la communauté djiboutienne.
Selon ce communiqué, Monsieur Dahan, ancien diplomate djiboutien,
réfugié au Canada, mettrait en cause gravement les accords
de Paris et la réelle volonté de négociation
de Monsieur Guelleh. Il estimerait que les chances de modifier le
caractère tyrannique et dictatorial du régime sont quasi
nulles et il n'accorderait qu'un crédit limité à
Monsieur Dini pour y parvenir.

une audience internationale et durable.
BILAN
SUR 18 MOIS
nous profitions
de ce numéro pour vous donner des informations complètes
sur la fréquentation du site et de nos publications et ce, pour
deux raisons :
- l'actualité
est en principe assez calme pendant la semaine du 15 août (sauf
événement imprévu que nous ne manquerons pas de
relater ),
- le site
a été ouvert il y a un an et demi et il a atteint son
rythme de croisière, ce qui permet de donner des informations
précises.
En 18 mois (depuis
février 99), plus de 520.000 pages
ont été consultées.
- Fin
septembre 99 :
lancement du premier journal libre 'LA LIBERTÉ',
- Février
99 :
la pointe de consultation correspond à la signature des accords
de Paris,
- Juin

disparition de 'LA LIBERTÉ' en tant que journal indépendant
pour laisser aux journalistes djiboutiens (en particulier LE RENOUVEAU
et LE TEMPS) la possibilité de s'exprimer sans concurrence étrangère.
Pour répondre à la demande de nombreux abonnés,
l'ARDHD prend alors la décision de relayer les informations des
Journalistes et des Associations sous forme d'un bulletin : elle héberge
les sites de la LDDH et du RENOUVEAU. Les autres journaux, associations,
partis ou syndicats pourront bénéficier, à leur
demande, des mêmes facilités.
- Juillet

le rythme journalier se maintient autour de 1.350 pages par jour. Il

LE DECRET QUI A PERMIS LA LIBERATION DU TERRORISTE ADWANI ETAIT BIEN
SIGNE PAR M. GUELLEH LUI-MÊME !
Le
22 juin 2000, M. Guelleh a signé le décret qui a permis
de libérer le terroriste Adwani, bien que celui-ci ait été
condamné à la prison à perpétuité.
Le décret a été publié dans le journal officiel
de Djibouti N° 12 du 29/06/00 sous le numéro 2000/0180/PRE.
Pour quelles raisons ???
"Par
décret n°2000-0180/PRE, du Président de la République
chef du Gouvernement, en date du 22 juin 2000, la peine de réclusions
criminelle à perpétuité que purge M. Adwani Hamouda
Ben Hassan est commuée à une peine à temps, couvrant
la période de sa détention.
Le
présent décret prend effet à compter du 30 juin
2000."

PART 1
GENERAL PRINCIPLES
ARTICLE ONE
SYSTEM OF THE
REPUBLIC
1. The system
of the new state of the Somali Republic is transitional and it shall
be based on sharia, democracy, justice, equality, peace, work and development.
The Somali Republic is independent and sovereign state, which respects
the dignity of the individual and integrity of the society.
2. Sovereignty
of the state belongs to the people who shall exercise it directly or
through their representative institutions and no individual or groups
of individuals may arrogate to exercise it.
3. The Somali
Republic shall adopt federal system of governance whose structure and
laws governing it shall be included in the new constitution to be prepared
by the transitional government. However, during the transitional period,
the republic shall adopt regional autonomy where certain political power
and administrative functions shall be devolved to the regions and districts
on the basis of individual equality and social justice.
4. The flag of
the Somali Republic is azure in colour and has a white star with five
equal points emblazoned in its centre.
5. The emblem
of the Somali Republic is composed of an azure escutcheon with a gold
border and bears a silver five-pointed star. The escutcheon, surmounted
by an embattlement with five points in Moorish stile, the two lateral
points halved, is borne by two leopards rampant in natural form facing
each other, resting on two lances crossing under the point of the escutcheon,
with two palm leaves in natural form interlaced with a white ribbon.
6. The capital
of the Somali Republic is Mogadishu, which shall have its own charter
establishing its special status.
ARTICLE TWO
PEOPLE, RELIGION
AND LANGUAGE
1. The people of the Somali Republic are one and indivisible.
2. Islam is the
Religion of the state and no other religion or ideas contrary to Islam
may be propagated in its territory.
3. The manner
of acquiring or losing citizenship shall be established by law. No Somali
citizen or his offspring may lose his citizenship on account of acquiring
citizenship of another country.
4. Somali and
Arabic shall be the official languages if the Somali Republic .
ARTICLE THREE
TERRITORY OF THE SOMALI REPUBLIC
1. The territory
of the Somali Republic is inviolable and indivisible.
2. The territorial
sovereignty of the Somali Republic extends to the continental territory,
the Islands, the Territorial Sea, the subsoil, the space above and continental
shelf.
3. The Somali
Republic is bound on the : West by Ethiopia ; North-west by the Republic
of Djibouti, North by the Gulf of Aden ; East by the Indian Ocean and
South by Kenya.
ARTICLE FOUR
SUPREMACY OF THE LAW
1. The law is
supreme and above every person.
2. The organisation
of the state and the relationship between the state and other persons,
public or private, shall be governed by law.
3. The generally
accepted rules of international law and international treaties duly
concluded by the Somali Republic in manner prescribed by law shall have
the force of law in into territory.
4. Islamic sharia
shall be the basis of legislation, and any law or regulation contrary
to it shall be invalid.
5. Any law or
regulation, which is contrary to this charter, shall be invalid.
ARTICLE
FIVE
HUMAN RIGHTS
1. The Somali
Republic recognises the declaration on human rights adopted by the United
Nations on 10 December 1948 ; the civil and political rights of 10 December
1948 as well as the economic, cultural and social rights and other conventions
pertaining to human rights to which the Republic is a party.
2. Every citizen
of the Somali Republic shall have the right to :
a) Life, personal
integrity and personal property. The death penalty may be imposed only
for crimes expressly defined by law.
b) Reside, work
and travel freely in any part of the Republic, leave the Republic and
retro, thereto and not to be subjected to deportation.
c) Found, organise
or associate with political, social, professional or labour organisations
without prior authorisation so long as the requirement of the law is
fulfilled. However, organisations which are secret or have military
or tribal character shall be prohibited.
d) Vote or be
elected so long as he satisfies requirement as specified by law.
ARTICLE SIX
AQUALITY OF CITIZEN BEFORE THE LAW
1. All citizens
are equal before the law without distinction on account of gender, creed,
dialect, clan lineage, ethnic origin, political conviction or social
status, while observing the principles of sharia and the sound cultural
heritage of the Somali people.
2. All citizen
shall have equal access to state employment and public service.
3. Aliens shall
have equal rights as the citizens before the law.
ARTICLE SEVEN
FREEDOM OF THE PRESS AND PUBLICATION
1. No laws restricting
the freedom of the press, broadcasting and publications of opinions
and ideas shall be established by the state save the rules regulating
them.
ARTICLE EIGHT
PERSONAL LIBERTY
1. The law shall
protect the fundamental rights and liberty of the individual.
2. Every person
shall have the right to individual liberty and personal freedom.
3. No person
shall be liable to my form of detention or other restriction of personal
liberty except when apprehended in the commission of crime or by a warrant
of arrest issued by a competent judicial authority, stating the grounds
thereof and in the manner prescribed by law.
4. In each case
of detention or other restriction of personal liberty, the reasons for
the measure shall be immediately communicated to the detainee and within
twenty-four hours, competent judicial authority, shall be notified of
the case.
5. No person
shall be subjected to inspection or personal search except for the provision
specified in paragraph 3 of this article and other cases as prescribed
by law for judicial, sanitary or fiscal reasons and in the manner prescribed
thereof in every case, the self-respected and moral dignity of the person
concerned shall be preserved.
6. Physical or
psychological violence against person detained shall be prohibited.
ARTICLE NINE
PRIVATE OWNERSHIP
1. The right
to own property shall be guaranteed by the state and the law shall define
the essence and limits of its uses.
2. Copyrights
pertaining to the arts, science and technology shall be protected by
law, which shall regulate the essence and limits of their uses.
3. Personal property
may be expropriated for reasons of public interest and in the manner
prescribed by law, in exchange for equitable and timely compensation.
However, in the event that the original need for the expropriation has
ceased, the property shall be returned to owner his heirs in accordance
with the law .
ARTICLE
10
RIGHTS TO LEGAL PROCEEDING AND SELF-DEFENCE
1. Every person shall have the right to initiate legal proceedings before
a legally constituted court.
2. Every person
shall be entitled to defend himself against any charges instituted at
any stage or level of legal proceedings with the right to engage a legal
counsel of his choice.
3. Every person
shall have the right to forward written petition to the government for
a redress of grievance and to have his petition examined.
ARTICLE ELEVEN
CRIMINAL LIABILITY AND POLITICAL ASYLUM
1. Criminal liability
shall be personal and accused shall repressed innocent until the conviction
has become final.
2. Any person
who has fled into the Somali Republic to escape prosecution of a crime
he had committed in his or another country may be returned only if extradition
treaty exists between Somalia and the state having jurisdiction over
the case. The Somali Republic may grant, on humanitarian grounds, political
asylum to a person and close relatives who fled their homeland or another's
country for a well founded fear of persecution, unless such asylum seekers
will been found to have committed crimes against humanity.
ARTICLE TWELVE
DUTIES OF THE INDIVIDUAL AND CITIZEN
1. Every person
shall loyally observe this charter and the laws of the country.
2. It is the
duty of every citizen to :
a) protect public
property and respect private property
b) Defend the
Republic, maintain and preserve the state secrets.
3. Every person
shall pay taxes dues in a accordance with the law.
ARTICLE THIRTEEN
THE ECONOMY
1 The state system
of the Somali Republic shall be based on free enterprise
2.The natural
resources of the country such as the minerals, water, wild life etc
; are public property, and special laws shall define the manner in which
they will be exploited for the common good.
3. The Somali
Republic shall welcome with full guarantee for foreign investment whose
operations shall be determined by special laws.
ARTICLE FOURTEEN
PUBLIC EDUCATION
1. The state
shall give high priority to the development and expansion of public
education.
2. Education
in Somali shall be designed to serve the national interest and shall
be spread trough the country.
3. The State
shall guarantee free basic education, which reaches up-to secondary
school level while it shall promote the development of institution of
higher learning including those of science and technology.
4. Private schools
and professional institutes may be established so long as they comply
with the laws as well as the national education policies and academic
curricula.
5. The State
shall encourage scientific research, inventions, innovations, the arts,
sports and promote the sound cultural heritage of the Somali people.
6. The State
shall adopt standardised curricula and unified educational policies
for schools throughout the Republic.
ARTICLE 15
SOCIAL WELFARE
1. It is the
responsibility of the State to maintain public health in general and
particular that of children and mothers for the prevention of epidemic
diseases and maintenance of general sanitation.
2. Private health
centres and clinics may be established
3. Parents shall
provide for the support, education and instruction of their children
and children who are of full age shall be obliged to support their parents
when the latter are unable to provide for themselves.
4. The State
shall safeguard public morality.
5. The State
shall protect :
a) Orphans, widows,
mothers and heroes in the defence of the motherland
b) The handicapped,
abandoned children and senior citizens with no one to care for.
6.
The State shall encourage the creation and development of social organisations
such as welfare, women, youth, students, professional and human rights
associations.
7. The State
shall endeavour to promoter the welfare and social development of the
rural population
8. The State
shall create empowering environment for women to participate effectively
in the economic, social and political life of the society.
9. Workers shall
have the right to receive, without any discrimination, equal pay for
work of equal value, one day of rest per week, other holidays and annual
leave with pay which they shall not be compelled to renounce.
10. Compulsory
labour of any kind shall be prohibited, with the exception of those
specified by law.
11. State employees
shall be guaranteed by law to receive their pension payment the law
shall define the pension rights of the workers in the private sector.
12. Law shall
establish the relationship between the transitional government and former
state employees.
ARTICLE 16
ENVIRONMENTAL PROTECTION
1. Saving the
environment shall be the top priority of the state and shall particularly
protect the national fauna and flora.
2. The State
shall adopt urgent measures to clean up the hazardous waste that has
been dumped on and off shores of the Somali Republic. Equitable compensation
shall be demanded of those found liable for such crimes.
3. The State
shall take steps on urgent basis to reverse the trend in environmental
degradation including pollution, poisonous chemical substance and industrial
waste and exportation of female animals or other kinds of the faunae
especially endangered species.
PART
TWO
THE TRANSITIONAL
NATIONAL ASSEMBLY (TNA)
ARTICLE 17
MEMBERS
1. The Transitional National Assembly (TNA), composed of 225 members
who are to be elected by their respective constituencies and to be approved
the national peace conference, shall be the highest legislative organ
of state which shall represent all of the people of the Somali Republic.
2. The total
number of the TNA membership specified in the previous paragraph includes
25 seats allocated for women. Women delegates shall elect the 25 members
from among themselves giving special consideration to the five social
groups at the conference. Also included in the Membership are 20 Members
to be appointed on their own merit, as approved by the conference on
8th August 2000.
3. The TNA shall
elect speaker and deputes' speaker and shall form functional committees.
4. Every member
of the TNA shall, before assuming his duties, take the following oath
of office : 'In the name of Good, I swear that discharge faithfully
my duties in the interest of the people and that I will abide by the
charter and laws of the Somali Republic'.
5. A candidate
for membership in the TNA shall fulfil the following requirements :
a) He must be
a citizen of the Somali Republic and has completed at least 25 years
of age.
b) He must be
in sound mind and
c) He must possess
academic qualification necessary in the effective discharge of his duties,
which cannot be lower than secondary level education or its equivalence.
ARTICLE 18
DUTTIES OF THE TNA
1. The Legislative
power shall be vested in the Transitional National Assembly, which shall
discharge the following duties :
1. Election of
the speaker and his deputies
2. Election of the President of the Republic
3. Enactment
of legislation
4. Establishment
of internal regulations'
5. Express vote
of confidence to the government
6. Approval of
the annual budget and accounting thereof
7. Establishment
of taxation laws
8. Ratification
of international treaties
9. Declaration
of state of war on proposal of the conical of ministers
10. Appointment
of special committees to investigate state agencies, whenever necessary
11. Approval
of the nominations of the Chief Justice of the Supreme Court, General
Accountant, Auditor General, Attorney General, The Governor of the Central
Bank, the Solicitor General and Members of the National Commissions.
ARTICLE NINETEEN
THE MEMBER
1. Without the
authorisation of the TNA, no criminal proceedings shall be instituted
against a member of the TNA, nor shall be arrested or deprived of personal
liberty nor his person or domicile be searched, nor shall he be interrogated
in connection with criminal investigation unless caught in the commission
of crime specified by law.
2. The decisions
of the TNA shall be reached by absolute majority vote unless the law
specifies otherwise, two-thirds of the TNA members present and voting
shall constitute a quorum.
3. The TNA shall
meet in its first session within 30 days from the date that the majority
of the members take oath of office.
4. The TNA shall
hold two ordinary sessions annually.
5. The TNA may
be convened in extraordinary sessions by the speaker, or at the request
of the President of the Republic, or of the government, or one-third
of its members.
6. For the duration
of their services in the TNA, members shall not engage in activities
that are incompatible with legislative duties, or can create, in appearance
or in reality, conflict of interest inimical to the national interest
or to the reputation of the Assembly.
7. Special regulations
shall establish the functions and emoluments of the Members.
ARTICLE TWENTY
TERM OF OFFICE AND QUALIFICATION
1. Every Member
of the TNA shall serve for a period of three (3) years, which shall
not be extended, nor shall the TNA be dissolved during the transitional
period.
2. Before the
election of the speaker, the most senior member in age shall preside
over the first session of the TNA.
3. A seat may
become vacant as a result of :
a) Written resignation,
death or incapacitation
b) Criminal conviction
4. A vacant seat shall be filled alternate member in the reserve list,
which contains a number corresponding with that the total TNA membership.
The new placements shall be approved by the TNA.
PART THREE
STRUCTURE OF THE STATE
ARTICLE TWENTY
ONE
ORGANIZATION OF THE STATE
1. The structure of the state shall be decentralised and shall consist
of :
a) central authority
b) Regional and district authority
c) Authority of the independent agencies
ARTICLE TWENTY- TWO
THE STATE
1. The transitional
system of governance shall be based on separation of powers of the state
as indicated below :
a) Legislative
branch (the TNA)
b) Executive branch (the government)
c) Judiciary branch
ARTICLE TWENTY-THREE
THE STATE
The President
of the Republic shall be elected by secret ballot by the TNA and may
person with the following qualifications shall be eligible to stand
for election to the Presidency :
1. He must be
a practicing Muslim. Both of his parents are original citizens of the
Somali Republic. He has never been married nor shall marry during his
term of office to a woman who is not an original citizen of the Republic.
2. He must be
a citizen of the Somali Republic who has attained at least 40 years
of age.
3. He must be
in a sound mind and has never been convicted a crime against the state
.
4. He has not
been engaged in professional or commercial activities that can create
conflict of interest between his personal affairs and requirement of
the office of the President.
5.
He must possess the capacity, competence and experience necessary for
the effective discharge of president duties.
ARTICLE TWENTY-FOUR
DUTIES OF THE PRESIDENT
1. The President
shall be the highest-ranking official in the country.
2. It shall be
the duty of the President to preserve the charter and laws of the country
and shall protect the national sovereignty and unity of the country.
3. Before the
assumption of the his duties, the President shall take the following
oath of office :
'In the name
of God I swear that I will discharge faithfully all my duties as President
in the interest of the people and that I will abide by charter and laws
of the Somali Republic'.
4. The President
shall sign into law legislation passed by the TNA and regulations and
decrees approved by the council of ministers.
5. The President
shall authorise the presentation to the TNA the draft legislation originating
with the government.
6. The President
address messages to the TNA, whenever necessary.
7. The President
shall sign international treaties upon authorisation of the TNA.
8. The President
shall nominate the Chief Justice of the Supreme Court.
9. The President
shall appoint the heads of national agencies on the proposal of the
Council of Ministers.
10. The President
shall appoint ambassadors to foreign countries and shall accredit and
receive foreign diplomatic representatives in the country.
11. The President
shall confer state honours.
12. The President
shall grant general and special pardon on the recommendation of the
relevant agencies.
13. The President
shall be the commander in chief of the armed forces.
14. The President
shall declare a state of war after authorisation from the TNA.
15. The President
shall preside over the meeting of the High Judicial Council.
16. The President
shall carry out any others functions assigned to him by law.
17. The President
shall be elected for a term of three (3) years.
18. In case written
resignation, death or permanent disability of the president of the Republic,
the speaker of the TNA shall with immediate effect exercise the functions
of the president and the TNA shall within thirty(30) days meet to elect
a new president of the republic.
ARTICLE TWENTY-FIVE
DUTIES OF THE COUNCIL OF MINISTERS
1. Executive
power shall be vested in the Council of Ministers.
2. The council
of Ministers shall consist of the Prime Ministers and Ministers whose
membership may not exceed twenty-five (25) in total.
3. The Prime
Minister shall have a deputy or deputies Prime Minister and ministers
and assistant ministers.
4. The Prime
Minister, deputies Prime Ministers, Ministers and assistant ministers
may be appointed from within or outside the TNA. However, nor member
of the TNA shall serve both in the executive and legislative branches
in the same term of offices.
5. The President
shall appoint the Prime Minister and dismiss in the event the latter
loses vote of confidence of theTNA.
6. The Government
shall obtain vote of confidence of the TNA within Thirty (30) days from
its formation.
7. The Prime
Minister and Ministers shall take the oath of office specified in paragraph
3 of article twenty-four of this charter.
8. The Council
of Ministers shall formulate and plan the national economic and political
policies.
9. The Council
of Ministers shall approve the draft legislation to be submitted to
the TNA for consideration.
10. The Council
of Ministers shall approve the nominations of heads of independent agencies
and other senior officials including general managers, directors and
generals.
ARTICLE TWENTY-SIX
DUTIES OF THE PRIME MINISTER
1. Decrees and
regulations approved by the Council of Ministers shall be counter signed
by the Prime Minister with the President in case there is no minister
with jurisdiction over the matter.
2. The Prime
Minister shall direct the general policy of the government and shall
be responsible thereof.
3. The Prime
Minister shall preside over the meetings of the Council of Ministers.
4. The Prime
Minister shall recommend to the President of the Republic names of individuals
to be appointed as ministers.
5. The Prime
Minister shall recommend to the President of the Republic names of individuals
to be appointed as ministers.
ARTICLE TWENTY-SEVEN
QUALIFICATION
Prospective Prime Minister or Minister must possess the following qualifications
:
1. Must be a citizen of the Somali Republic
2. The Prospective
Prime Minister must have attained at least forty(40) years of age and
Minister at least thirty-five (35) years of age.
3. Prospective
Prime Minister or Minister must possess a degree from a recognised university
or its equivalencies.
4. The prospective
Prime Minister or Minister must be a practiting Muslim.
5. No criminal
proceedings shall be instituted against the Prime Minister or the Ministers,
nor shall the Prime Minister or a Minister be arrested nor shall his
person or domicile be searched or be interrogated as object of criminal
investigation unless caught in the commission of a crime or authorised
by the TNA a majority vote of two-thirds of its members.
ARTICLE TWENTY-EIGHT
FORMATION OF SECURITY AND DEFENSE FORCES
1. Armed Forces
consisting of national police and army shall be established.
2. Every region
of the country shall from its own police force with adequate capability
to maintain law and order.
3. Special laws shall define the establishment of the armed forces and
the manner of their collaboration.
ARTICLE TWENTY-NINE
STATE AGENCIES
These agencies
shall be established :
1. Auditor General
2. Attorney General
3. Accountant General
4. Central Bank
5. Solicitor General
ARTICLE THIRTY
NATIONAL COMMISSIONS
The following
commissions whose members shall be appointed and supervised by the Council
of Ministers shall established.
1. National Commission for Reconciliation's and Property Settlement
2. National Constitutional Commission
3. National Census Bureau
4. Civil Service Commission
5. Human Rights Commission
6. National Commission for the return of public property
7. National Resettlement Commission
8. National Election Commission
9. Somali Olympic Commission
ARTICLE THIRTY-ONE
TRADITIONAL LEADERS COUNCIL (TLC)
Traditional Leaders
Council (TLC) shall be established to advice the government on the following.
1. Pacification
and resolution of communal conflict
2. Distribution of public services
3. Disarmament, rehabilitation of militias and population census
4. Promotion of traditional values.
5. Development of effective local administrations
6. Programme deemed important by the government
7. Members of the TLC shall not be subject to arrest without authorisation
of the internal affairs minister
8. Special law shall define TLC's emoluments.
PART FOUR
REGIONAL AUTONOMY
ARTICLE THIRTY-TWO
REGIONS AND DISTRICTS
1. During the
transitional period, during which the federal system of governance is
being prepared, full administrative power shall devolved to the regions.
2. The regions
shall exercise their administrative authority in accordance with the
law.
3. The regions
shall comprise of the eighteen (18) administrative regions established
before the civil war.
4. Special laws
shall specify the structure, and power of the regions as well as the
relationship between the central and local authorities.
5. Regional councils
shall be made up of representatives of the districts.
6. Every regional
council shall establish administrative committee led the regional governor.
7. District Council
shall be composed of representatives elected from the villages and localities.
8. Prospective
members of the district and regional councils shall fulfil the following
requirements.
a) They must
be Somali citizens ho have completed at least the 25 years of age.
b) They must be in sound mind
c) They must
possess the capacity to carry out their duties effectively
d) They must
have never been sentenced to serve in prison for a period of up-to one-year.
9. Members of the district and regional councils may lose membership
in the respective bodies the same manner as that of the TNA.
10. Allowances
and salaries of the district and regional council members and their
employees shall be determined and paid out by their respective authorities.
11. The total number of the membership of every district or regional
council shall be determined by law, and may issue local ordinances in
conformity with the laws.
12. regional
autonomy shall not in any way affect the rights of the citizens of the
Somali Republic as prescribed by the charter.
PART FIVE
JURICIARY
ARTICLE THIRTY-THREE
INDEPENDENCE OF THE JUDICIARY
1. The Judiciary shall be independent of the executive and legislative
branches and in exercise of their judicial functions, the members of
the judiciary shall be subject only law. The judicial power shall be
bested in the courts.
2. Judges may
not be dismissed, demoted or transferred unless so specified by laws.
3. The Higher
Judicial Council shall be the highest administrative organ of the judiciary.
It shall be composed of the Chief Justice and two members of the Supreme
Court, the Attorney General and five jurists who are not in the employment
of the state. Three of the jurists shall be appointed by the TNA and
the other two by the Council of Ministers. The Higher Judicial council
shall be responsible for :
a) The appointment
of judges
b) The administration and supervision of the courts as well the promotion,
discipline and dismissal of judges
4. The Court
system shall consist of :
a) The Supreme
Court
b) The Appeal court
c) The Trial court or Court of First Instances (of District and Regional
levels).
5. The Supreme
court or shall be based in the capital of the Somali Republic.
6. The power
of the judiciary and rules on the administration of the courts shall
be defined by laws.
7. No special
courts shall be established with the exception of tribunals, which shall
have jurisdiction only over the offences committed by members of the
armed forces.
ARTICLE THIRTY-
FOUR
THE ATTORNEY GENERAL
1. The Attorney
general shall be an internal part of the judiciary organ, which shall
consist of :
a) The office
of the Attorney General which shall jurisdiction over the entire territory
of the Somali Republic
b) Regional Attorney
2. The office
of the Attorney General shall be established in the capital of the republic
which shall be responsible for :
a) The enforcement
of the lax
b) Investigating in all criminal cases and bringing charges thereof.
c) Supervision of prisons and juvenile correctional institutions.
d) The protection and defence of the right of orphans and mentally handicapped.
e) Execution of any duties assigned to it by law.
ARTICLE THIRTY-FIVE
CONFORMITY
Conformity of
the Charter and laws of the Republic with Islamic Sharia shall be decided
by the Supreme Court which shall issue reasoned judgement to be published
in the same manner as other laws.
ARTICLE THIRTY-
SIX
APPONTMENT
Appointment of
Judges and state attorneys shall be governed by the legal competence
of the candidates to such post, which shall be decayed by competitive
examinations.
ARTICLE THIRTY-SEVEN
JUDICAL IMMUNITY
No criminal proceedings
shall be instituted against a sitting judge, nor shall he be arrested
nor his person or domicile be searched without the authorisation of
the higher judicial council or except in case of flagrant delicto for
a crime in which a warrant or order of arrest is mandatory. In such
case, the Chief Justice of the upreme Court shall immediately be notified
of the matter.
PART SIX
MISCELLANEAOUS
ARTICLE THIRTY EIGHT
1. Upon formation
of national authority, all public properties shall revert to state ownership.
2. The national
authority shall devote the necessary efforts to restore peace and security
in the country, collection of firearms in the hands of the general public
and rehabilitation of the various militia groups with the co-operation
of the regional authorities.
3. The internally
displaced persons shall be resettled
4. The rehabilitation
and development programmes currently in progress in Somalia shall be
continued unless they shall be found to violate the independence and
sovereignty of the Somalia Republic.
5. Effective
from the date a national authority is formed by the national peace conference
at arta, Djibouti, any political of militia organisation in the territory
of the Somali Republic shall cease to exist.
6. Armed groups
in the territory of the Somali Republic shall turn in their weapons
to the national authority.
7. The national
authority shall establish special laws regulating formation of political
parties in the Somali Republic.
8. The transitional
national authority shall prepare a federal system of governance.
9. This charter
shall be the foundation of the constitution, which will be adopted by
popular referendum during the transitional period.
10. Transitional
period of three (3) years shall commence with the conclusion of national
peace conference at Arta, Djibouti.
11. The TNA shall
turn into a constituent assembly twelve (12) mouths before the en of
the transitional period.
12. The Somali
constitution which was adopted in 1960 and other laws of that period
which are not contrary to this charter shall have the force of law in
the Somali Republic.
13. The transitional
national authority shall endeavour to stampout nepotism, favouritism
and any from of corrupt practices in the Somali Republic.
14. This Charter
shall come into force on the date the delegates at the National Peace
conference at Arta, Djibouti shall have approved it.
15. The National
Authority shall prepare in the last twelve (12) months of the transitional
period electoral laws, referendum and federal system.
16. The Somali
text shall be the office version of the Charter.

Esber Yagmurdereli,
lauréat du sixième Prix "LUDOVIC-TRARIEUX",
est emprisonné depuis Juin 1998, après avoir déjà
purgé treize ans et cinq mois de prison de 1978 à 1991,
parce que condamné pour un discours, prononcé peu après
sa libération lors dune manifestation de lAssociation
turque des droits de lHomme à Istanbul en faveur dune
solution pacifique dans le sud-est.
Il est actuellement
dans la prison de Çankiri, à 130 kilomètres dAnkara,
où il purge une peine demprisonnement cumulée de
23 ans. En septembre 1999, il ne put bénéficier de la
loi turque sur la suspension des sentences parce que son " crime
" était un discours. On pense que le gouvernement turc a
l'intention de le maintenir en prison jusquà 2015.

L'emprisonnement
d'Esber Yagmurdereli est une violation des obligations souscrites par

de l'homme. Son procès a contrevenu aux règles les plus
élementaires de l'article 6 de la Convention.

chef de la Cour constitutionnelle élu depuis le 5 mai 2000 et
demandez la libération immédiate et inconditionnelle d'Esber
Yagmurdereli.
L'ancien président de la Cour constitutionnelle est le premier
président turc juriste de formation. M. Sezer, passe pour être
partisan de démocratiser un pays jusqu'ici trop connu pour ses
atteintes aux droits de l'homme en particulier dans la reconnaissance
des minorités, au premier rang desquelles les 12 millions de
Kurdes.
Dans son premier
discours public, M. Sezer, considéré comme un homme de
principes, a estimé que le chef de l'Etat disposait de pouvoirs
trop importants et que le droit de veto présidentiel sur les
textes votés par le Parlement était anti-démocratique.
''Les pouvoirs
attribués au président dépassent les frontières
de la démocratie'', a déclaré le successeur de
Suleyman Demirel, qui préconise une modification des lois antiterroristes
en vigueur. Au nom de celles-ci, des centaines de personnes ont été
emprisonnées, accusées de subversion pour s'être
exprimées publiquement sur la question kurde, pour avoir rédigé
des livres ou des articles jugés menaçants pour la sécurité
nationale.
Necdet Sezer
a souligné les lacunes de la Turquie en matière de démocratie
et indiqué qu'il préserverait "sans faille"
les principes laïcs. "Dans la vie politique et sociale en
Turquie, la démocratie n'est pas suffisamment développée
et n'est pas ancrée dans les traditions" a déclaré
le nouveau chef de l'Etat promettant de se conformer pleinement à
la Constitution de 1982 qu'il a par le passé plusieurs fois critiquée
pour ses déficiences dans le domaine des droits de l'Homme.

Je
souhaite vous exprimer ma très vive préoccupation sur
le cas de M. Esber Yagmurdereli, avocat et défenseur des droits
de l'homme qui purge actuellement une peine d'emprisonnement de 17 ans.
M.
Yagmurdereli, avocat aveugle depuis lâge de dix ans, a été
condamné à 10 mois demprisonnement pour un discours
qu'il a prononcé, en 1991, sur la situation de la population
Kurde en Turquie. Cette condamnation a réactivé la peine
qu'il avait encourue en 1978 après un procès inéquitable
et dont lexécution avait été suspendue en
1991 à condition qu'il ne commette pas un nouveau délit
de nature politique.
Je crois que M. Esber Yagmurdereli fait partie dun groupe d'intellectuels
turcs qui, en affrontant publiquement l'Etat sur la question de la liberté
d'expression, mettent leur propre liberté en péril.
Le
"délit d'opinion" est en soi inadmissible dans un Etat
qui se réclame de la solidarité européenne. Mais
qu'un tel "délit" puisse mettre fin à un sursis
prononcé en 1991, cela est tout à fait incompréhensible.
Je
considère M. Yagmurdereli comme un prisonnier de conscience,
aujourdhui détenu pour avoir exercé son droit à
la liberté d'expression garanti par Article 19 de la Déclaration
Universelle de Droits lHomme et larticle 10 de la Convention
Européenne des Droits de lHomme.
J'ai
été heureux de savoir que son engagement pour la defense
des droits humains a été reconnu quand en mars lui a été
décerné le Prix International des Droits de lHomme
" Ludovic Trarieux ".
En
conséquence, Je vous prie donc respectueusement de tout mettre
en uvre afin d'obtenir la libération immédiate et
inconditionnelle de Esber Yagmurdereli ainsi que la mise en place d'une
réforme de la législation turque en matière de
liberté d'expression.
En
septembre 1999, le gouvernement Turc a accordé une amnistie qui
a permis à quelques écrivains et journalistes d'être
libéré de prison. Cependant, l'amnistie ne sest
pas appliquée à M. Yagmurdereli parce qu'il a prononcé
verbalement, et non pas écrit, ses commentaires au sujet des
droits des Kurdes.
Depuis
maintenant 21 ans, M. Yagmurdereli na cessé se sortir et
de retourner en prison. Daprès ce que nous comprenons,
Yagmurdereli sest borné à exprimer ses opinions
simplement et pacifiquement et, à défendre en tant quavocat,
dautres individus poursuivis selon la loi turque.
Il
est bien connu que M.Yagmurdereli a souffert, entre autres maladies,
d'hypertension et de maux d'estomac, au cours de sa dernière
période d'incarcération.
La
libération de Yagmurdereli démontrerait que votre gouvernement
s'est engagé dans la voie dune démocratie véritable
et a fait le choix délibéré de l'Europe. Elle serait
accueilli chaleureusement par lensemble des défenseurs
des droits de lhomme du monde entier.
Nous

les plus expresses réserves doivent être exprimées
sur la façon dont le gouvernement d'Ankara assure la protection
des minorités.
Que la Turquie
viole les standards européens de la liberté d'expression
communément admis dans les Etats mmbres de l'Union et refuse
d'accorder aux minorités des droits aussi élémentaires
que le droit à l'education dans sa propre lanque à la

Que l'emprisonnement
d'Esber Yagmurdereli constitue une violation des obligations signées
et ratifiées par les autorités turques et notamment des
articles 10 de la Convention européenne des droits de l'Homme,
et une contravention à la déclaration de l'ONU sur les
défenseurs des droits de l'homme et que son procè a contrevenu
aux règles les plus élementaires garanties par l'article
6 de la Convention.
Que la libération
d'Esber Yagmurdereli et des autres prisonniers politiques turcs doit
être le préalable à l'examen de la candidature de
la Turquie à l'Union européenne et que doit être
également au préalabe abrogée la législation
permettant les poursuites contre les défenseurs des droits de
l'homme et de la liberté d'expression.
